Pharmaceutical Counsel The candidate provides legal services and counsel to the company's Pharmaceuticals Corporation management and employees. Primarily support the US Oncology Business Unit Represents the company and provides legal services to commercial, medical and support functions in the organization. Support Commercial Operations to ensure competitive brand-building. Provide timely, strategic and proactive advice on promotional issues to drive intelligent risk-taking and creative solutions to competitive issues. Defend the company's brands against competitive attack. Challenge competitors' activity where appropriate to gain competitive advantage. Manage Legal Risk and facilitate Innovation. Advise on risks/ formulate strategy to achieve BU innovation goals while protecting assets/reputation. Provide training on drug advertising and promotion rules, off-label promotion risks, product liability risks and identify other training needs. Coordinate with and train DRA, Medical and CS&E to reduce product liability exposure. Support Medical Affairs and other non-commercial functions. Draft and negotiate vendor, services, consulting, license, data purchase, and other agreements. Provide strategic advice on partnering with patient advocacy organizations and other not-for-profit organizations. Coordinate with General Medicines organization on policy decisions pertaining to Ethics & Compliance and other functions. Draft and review contracts in the ordinary course of business.

A JD/LLB or foreign equivalent is required. 5-10 years of experience in a business-oriented law firm, corporate legal organization, governmental agency or equivalent. Corporate and/or pharmaceuticals legal expertise desirable. Experience handling corporate transactions, defending corporate entities in litigation, handling corporate investigations, and/or advising on corporate compliance programs is desirable. Good working knowledge of Pharma business, its objectives and their legal ramifications preferred. Should have good understanding of FDA regulations, pharmaceutical or other regulated industry advertising, health care fraud, state laws governing interactions with healthcare professionals and product liability experience strongly preferred. Should have experience with a broad range of business transactional matters, including counseling, negotiation and document drafting and review. Ability to handle substantive issues and documents for all phases of significant transactions required. Should be knowledgeable in litigation techniques and should have supervised or handled directly a variety of significant litigated matters. Should have experience counseling clients in the day-to-day operation of a business is required. Ability to work on cross-functional terms and lead such teams is essential.
